In 1961, New York completely banned tattooing due to public health risks. The ban lasted 36 years and became one of the most famous examples of how the absence of safety standards can affect an entire industry. In the modern world, tattoos have become part of culture, art and self-expression. But few know that one of the largest megacities in the world — New York — officially banned tattooing for almost forty years.
The reason was not a fight against art or a desire to limit people's freedom. The reason was much more serious — a matter of public health.
A story that changed the industry
In 1961, the New York authorities imposed a complete ban on the activities of tattoo artists after a hepatitis outbreak. At that time, there were no unified safety standards, sterility control or verification of masters' knowledge. Regulators believed that non-sterile equipment and the absence of proper control could pose a threat to public health.
The ban lasted until 1997. Thirty-six years. A whole generation of masters worked virtually outside the law.
But the most interesting thing happened after the ban was lifted. The state drew a conclusion that is now recognized throughout the world: bans do not work. If an industry exists, it should not be banned — it should be regulated.
That is why after legalization, New York introduced a system of knowledge control, infection safety training, exams and professional standards. A client can evaluate a sketch. A client can evaluate a portfolio. A client can evaluate a healed work. But a client practically cannot evaluate the level of a master's knowledge regarding infection control. They do not see how well the master understands the principles of sterility.
